1. Scope

These General Terms and Conditions apply to all orders placed via our online shop Kreativschicht.de by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

An entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the order button, the customer submits a binding offer to purchase the goods in the shopping cart.

The contract is concluded as soon as we accept the order through an order confirmation by email or dispatch the goods or provide digital content.

4. Prices and Payment Terms

All stated prices are final prices.

Insofar as the small business regulation according to § 19 UStG applies, no sales tax will be shown.

The available payment methods will be displayed during the ordering process.

5. Delivery and Provision

Physical Products

Delivery will be made to the delivery address provided by the customer.

Delivery times can be found in the respective product description.

Digital Products

Digital products will be made available for download or delivered by email after successful payment.

The customer is responsible for ensuring the technical requirements for using the digital content.

6. Customer Account

The customer can voluntarily create a customer account.

The customer is obliged to treat their access data confidentially and to protect it from third-party access.

7. Retention of Title

The delivered goods remain our property until full payment has been received.

8. Personalized Products

For personalized products, the information provided by the customer will be adopted unchanged.

The customer is obliged to carefully check all information before completing the order.

We assume no liability for errors due to incorrect customer input.

9. Digital Content and Usage Rights

By purchasing digital products, the customer receives a simple, non-transferable right of use for the intended purpose.

Unless otherwise stated in the respective product description, the following is particularly not permitted:

• Resale

• Transfer to third parties

• Publication

• Reproduction for commercial purposes

• Distribution via platforms or download portals

All copyrights remain with Kreativschicht.de or the respective rights holders.

10. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.

The details can be found in the separate withdrawal policy.

For personalized products and certain digital content, statutory exceptions to the right of withdrawal may apply.

11. Warranty

The statutory liability for defects applies.

In the case of handmade products, natural materials, or personalized products, minor deviations in color, grain, material structure, or representation do not constitute a defect, provided that the agreed quality is not significantly impaired.

12. Liability

We are liable without limitation for damages resulting from injury to life, body, or health, as well as for intent and gross negligence.

In the event of slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable, typical damage for the contract.

Otherwise, liability is excluded to the extent permitted by law.

13. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies to the extent that it does not restrict any mandatory statutory provisions of the state in which the consumer has their habitual residence.

14. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Final Provisions

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
